At Edukapi SpA (hereinafter, "Edukapi" or "We"), we respect the User’s privacy, and are strongly committed to keeping secure any information obtained from them through their interaction with or use of the Platform and/or the Services.

All capitalized terms not expressly defined in this document shall have the meaning given to them in our Terms and Conditions.

0. Scope, Legislation, and Initial Considerations

a. International Coverage:

  • Edukapi is available for download in more than 173 countries through Google Play and in more than 175 countries through the App Store.
  • Each User is responsible for verifying the local laws and regulations of the country in which they use the application or access our Services, especially if they decide to change location. Edukapi cannot know or be responsible for the User’s jurisdiction changes or compliance with applicable local law in such cases.

b. Languages and Translations:

  • Edukapi may offer translations of this Privacy Policy and of the Terms and Conditions into different languages.
  • We are not responsible for 100% accuracy of translations. In case of doubt or conflict, it is recommended to read the English or Spanish version.

c. Minimum Age and Applicable Legislation:

  • When a country has no clear or specific legislation regarding data protection or the minimum age for using digital services, the minimum age established by the GDPR (General Data Protection Regulation) shall apply.
  • All minors under such minimum age will be required to have parental control and authorization of the legal representative (parent or guardian). Users older than the minimum age will be asked for their express consent in clear and simple language, explicitly indicating what they may do within the Platform.
  • Edukapi does not knowingly collect personal information or Personal Data from minors under 18 without the consent of their legal representative. In accordance with the Terms and Conditions, for contractual and legal purposes, minors under 18 must use the Platform and Services through their legal representative (parents or guardian). Edukapi is not responsible for false information entered to bypass the age requirement.
  • Parents or legal guardians have the right to review their children’s Personal Data and request its deletion and Account cancellation by contacting Edukapi through the channels indicated in the User Rights clause.

d. Email Verification and Responsibility for Data Provided:

  • Edukapi relies on the truthfulness of the information provided by the User (for example, the parent’s or guardian’s email). If the User enters incorrect email or other data, it will be their responsibility to correct such data, for which the Platform may enable editing tools.
  • Entering a false or incorrect email may impact access to Services and communication with the legal representative, therefore Edukapi reserves the right to take necessary measures to protect compliance and Platform security.

e. Reservation of Rights:

  • Edukapi reserves all rights regarding the use and operation of the Platform, as well as protection of its legitimate interests. This text does not limit Edukapi’s ability to take any actions deemed necessary to safeguard its rights and interests and comply with applicable law.

1. Information Collection

a. Personal Data:

The information requested by Edukapi to create a User Account, namely full name, age, email address (hereinafter, "Personal Data"), and general application preferences, are the only data requested from the User, obtained voluntarily. The Personal Data provided by the User will remain strictly confidential, and the User will always have the rights granted by Law No. 19.628 on the Protection of Private Life, as indicated in clause 17 of our Terms and Conditions and this Privacy Policy.

Such Personal Data will be used to validate the User’s identity and offer personalized Services according to their interests and preferences, as well as to generate internal statistics that make interaction more effective. Under no circumstances will Personal Data be transferred to third parties, except when expressly authorized by the User, required by law, or ordered by judicial resolution. Statistical Data, which cannot be associated with an identified or identifiable subject, may be used for commercial purposes and brand valuation.

By accepting the Terms and Conditions and this Privacy Policy, the User expressly authorizes Edukapi to process their Personal Data in accordance with Law No. 19.628, especially for proper identification, contact information, and other data essential for the proper functioning and improvement of Services. This includes all operations defined by the aforementioned Law.

The information provided by the User must be accurate and truthful, being their sole responsibility if incorrect. Edukapi is not responsible for false data entered to bypass the required age or other obligations. Personal Data must always be accurate, up-to-date, and truthful. Edukapi does not guarantee the accuracy of Personal Data since it is provided solely by the User.

b. User Content:

By using the Services, the User will generate content based on interactions on the Platform, as well as on other networks where Edukapi has active accounts, such as Instagram, Facebook, TikTok, X, YouTube, Discord, and LinkedIn. "User Content" is any content created or uploaded by the User to the Platform or such networks: text, math problems, photos, videos, images, files, comments, suggestions, feedback, ideas, bug reports, and any other submitted information.

User Content is not considered confidential.

The User is solely responsible for their User Content, as stated in our Terms and Conditions.

By uploading User Content, the User irrevocably grants Edukapi a license over all rights, allowing Edukapi to use it at its discretion, for any purpose, in accordance with clause 7 of the Terms and Conditions. The User guarantees they have the rights or authorizations to upload such content and that it does not infringe intellectual property or other rights of third parties.

Edukapi expressly refers to clause 7 of the Terms and Conditions regarding this matter.

c. Other Information:

(i)
Registration data and device information: Edukapi will automatically receive information from the User’s browser when interacting with the Platform or using the Services, including device type and name, operating system, device identifiers, IP address, browser type and configuration, system connection, date, time, location, and how the User interacts with the Platform.
(ii)
Usage Data: Edukapi will receive information about use of Services and interaction with the Platform, such as questions asked, uploaded content, features used, actions taken, time zone, country, and access dates/times.

d. Social Interactions ("Friends")

When using the "Friends" function, the User (or their guardian) agrees that Edukapi may process the following additional information:

(i)
Contact list and invitation status.
(ii)
Messages, files, and reactions within chats or groups.
(iii)
Usage data (date, time, and duration of conversations).

Interactions within the "Friends" feature will be stored and processed to: (i) provide the educational messaging service; (ii) detect and prevent cyberbullying, grooming, or spam; and (iii) improve collaborative learning. Access to such content will be limited to conversation participants, except Edukapi staff may review it if a report or security need arises. Conversations are retained while the account is active, unless deleted by the guardian or law requires otherwise. If the User is under the digital age of consent, activation follows the parental consent email flow, which can be revoked at any time. Each chat/message includes a "Report" button, and Edukapi may issue warnings, suspensions, or account termination as needed.

2. Use of Information

Edukapi may use information provided to: (i) validate User identity; (ii) provide better Services; (iii) respond to User inquiries; (iv) inform about new tools or policy changes; (v) improve the Platform; (vi) analyze statistics and perform email marketing with anonymized data; (vii) improve Service management; (viii) train new models and develop programs; (ix) process transactions; (x) prevent fraud or illegal activities; (xi) protect Edukapi’s IT systems; and (xii) comply with legal obligations and protect rights. (xiii) Manage ads in the App and Platform, ensuring compliance with COPPA and GDPR.

  • Third-party ad providers: Edukapi may work with networks (Google, Facebook, etc.) to show personalized/non-personalized ads.
  • Limitation for minors: No personalized ads will be shown to minors below the legal digital consent age.
  • Opt-out options: Users can disable personalized ads in account/device settings or via third-party tools. Ads may still appear, but non-personalized.
  • Mobile settings: iOS/Android devices offer settings for managing data used for ads (Advertising ID).
  • Ad-free subscriptions: Edukapi may offer plans with no ads.

Edukapi will not transfer Users’ Personal Data to third parties except when authorized, required by law, or ordered judicially. Statistical Data may be used for commercial purposes and brand valuation.

3. Storage of Information

Edukapi uses data centers in Chile, the US, and other countries. By using Services, the User consents to cross-border storage, subject to security measures.

Edukapi may change hosting providers, cloud services, or analytics providers, ensuring compliance. Third parties will only have access to data within their role.

Personal Data will be deleted when the account is deleted, except email may be retained in anonymized form to prevent duplicate accounts.

4. Data Security

Edukapi will implement technical/organizational measures to protect Personal Data. However, no system is fully secure. Users accept that Edukapi cannot guarantee absolute security, beyond applying best practices.

All chats include a "Report" option. Edukapi staff handling reports use MFA authentication.

5. Cookies

The Platform may use cookies, web beacons, and similar technologies to track behavior, remember preferences, and improve Services. Third-party cookies may also be included.

Users may configure browsers to accept/reject cookies. Rejecting may affect functionality.

6. User Rights

Users may:

  • Access their Personal Data;
  • Delete their Personal Data by deleting their Account;
  • Rectify or update their Personal Data;
  • Restrict processing (e.g., cookie preferences).

7. User Privacy Obligations

Users agree: (i) respect others’ privacy; (ii) not collect data without consent; (iii) not disclose others’ Personal Data; (iv) not provide false data or create accounts for others without authorization.

8. Minors

Edukapi does not intentionally collect Personal Data from minors without prior parental consent. Definitions of "minor" follow local digital consent laws (e.g., COPPA in US, GDPR in EU).

Minors must use the Platform through their legal representative. Edukapi is not responsible for false info entered to bypass requirements.

Edukapi offers an inclusive but safe Platform. If a minor registers, it is assumed they act through their legal representative.

Parents/guardians may review or delete their child’s data at any time.

9. Changes to Privacy Policy

Edukapi may update this Privacy Policy at any time. Users will be notified via email and the updated version will be posted on the Platform. Continued use implies acceptance.
